1. Authorization & Access: The customer authorizes Duct Shine and its employees, agents, or subcontractors to access the property to perform the cleaning services outlined in the booking, quote, or invoice.
2. Safe Access: The customer must ensure that Duct Shine has clear and safe access to the premises and the work area. Any delays or obstructions may result in additional charges.
3. Structural Alterations: If the work requires cutting or modifying any part of the property (such as vents, ceilings, or walls), Duct Shine will seek the customer's consent beforehand unless it's an emergency. In emergencies, Duct Shine may proceed without prior approval.
4. Emergency Work: Duct Shine is not liable for damage during emergency work unless caused by gross negligence or willful misconduct. If the customer requests restoration after such work, the cost will be additional.
5. Liability for Existing Components: Duct Shine is not responsible for damage to existing ductwork, vents, piping, fittings, or equipment during the cleaning unless due to negligence.
6. Code Compliance: Duct Shine does not correct pre-existing code violations unless agreed upon in writing. Any violations discovered will be reported to the customer and quoted separately.
7. Hazardous Conditions: The customer agrees to inform Duct Shine of any known hazardous materials (asbestos, mold, lead, etc.) before work begins. Duct Shine is not liable for issues arising from unknown hazardous materials.
8. Ownership of Materials: Ownership of any materials provided passes to the customer once full payment is received.
9. Acceptance of Work: Customer approval, whether verbal, signed, or through payment, indicates acceptance of these terms and the completion of work as described.
10. Payment Terms: Unless otherwise agreed in writing, payment is due at the time of service. We accept cash, bank transfer, and card payments. Bank details will be provided on the invoice.
11. Warranty: All services and materials are warranted to be free from defects in workmanship for 30 days from the date of invoice. Manufacturer warranties are passed on to the customer. Warranty work is done during normal hours (Mon–Fri, 8 a.m.–6 p.m.). Emergency or out-of-hours warranty work will incur extra charges.
12. Work Commencement: Work commencement constitutes acceptance of these terms by the customer.
13. Third-Party Property: If the customer is not the property owner, they confirm that permission has been granted for Duct Shine to perform the services. The customer is responsible for any costs or claims resulting from a lack of authorization.
14. Recovery of Costs: Customers agree to cover all legal or collection costs incurred by Duct Shine due to payment defaults or breaches of these terms.
15. Governing Law: These terms are governed by UK law. Any disputes shall be resolved in the courts of the United Kingdom.
16. Use of Customer Names: Duct Shine may use business/customer names and logos on its website for testimonial and review purposes only. No personal data will be shared with third parties without consent.
17. Limitations: Duct Shine's scope of work does not include building or electrical work unless agreed in writing. Any openings required for duct access must be arranged and sealed by the customer’s contractor. Duct Shine is not responsible for damage due to improper sealing.
18. Permissions & Approvals: It is the customer's responsibility to obtain all necessary planning permissions before work begins. Duct Shine is not liable for any work delays or legal issues arising from failure to do so.
